01 Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Magic Bite ("we," "us" or "our"), concerning your access to and use of our website (powered by Odoo) as well as any other media form related, linked, or otherwise connected thereto.

By accessing the Site and placing an order for our cakes, pastries, or other bakery items, you acknowledge that you have read, understood, and agreed to be bound by all of these Terms and Conditions. If you do not agree with all of these terms, then you are expressly prohibited from using the Site and must discontinue use immediately.

02 Product Disclaimer & Hand-Made Nature

We take pride in the fact that all Magic Bite products are home-made and handcrafted by passionate bakers. Unlike factory-produced items, our cakes are unique creations.

• Visual Variations: The images shown on the website are for reference purposes. Since every cake is hand-decorated, there may be slight variations in design, color shades, or garnish placement compared to the picture.
• Availability of Ingredients: Seasonal fruits (like strawberries or mangoes) and specific decorations are subject to availability in the local market. We reserve the right to substitute ingredients of equal or higher quality without prior notice.
• Weight Variance: Hand-baked cakes may vary slightly in final weight (approx +/- 5% to 10%) due to baking loss and decoration density.

03 Food Safety & Allergy Warning

While we maintain the highest standards of hygiene in our home kitchen, our products are baked in a facility that handles various ingredients.

• Allergens: Our cakes may contain or come into contact with milk, wheat (gluten), nuts (almonds, cashews, walnuts), soy, and eggs (unless specifically ordered as Eggless).
• Customer Responsibility: It is the customer's responsibility to inform us of any severe allergies at the time of placing the order via the "Notes" section or WhatsApp. Magic Bite cannot be held liable for allergic reactions if no prior information was provided.
• Non-Edible Items: Some custom cakes may contain non-edible support structures (dowels, toothpicks, plastic figures, or fresh flowers). Please remove these before consumption.

04 Ordering & Payments

We use secure technology to manage your orders. By placing an order, you agree to the following:

• Advance Booking: To ensure freshness, we recommend placing orders at least 24 hours in advance. Same-day orders are subject to slot availability.
• Pricing: Prices for our products are subject to change without notice. The price charged will be the one displayed at the time of order confirmation.
• Payment Security: We use trusted third-party payment gateways (UPI, Razorpay, etc.). We do not store your banking details. You agree to pay the full amount for the order, including any applicable delivery charges.

05 Delivery Policy

We currently deliver to specific pincodes in Dharmanagar (e.g., 799250, 799251, 799253). Delivery is handled by our local team or trusted partners.

• Recipient Availability: Please ensure someone is available to receive the order at the scheduled time. If the recipient is unavailable or the phone is unreachable, the cake will be returned to our kitchen. No refund will be provided in such cases as the product is perishable.
• Address Accuracy: Magic Bite is not responsible for failed deliveries due to incorrect or incomplete addresses provided by the user.
• Damage in Transit: While we take extreme care, minor smudges on cream cakes during transit on local roads may happen. However, if a cake is significantly damaged (collapsed), please contact us immediately upon delivery for a resolution.

06 Storage & Consumption

Our cakes (especially "Ice Cakes" or Fresh Cream Cakes) are temperature sensitive.

• Immediate Refrigeration: All cream cakes must be refrigerated immediately upon delivery. Leaving them at room temperature for long periods may cause melting or spoilage.
• Shelf Life: We recommend consuming our cakes within 48 hours of delivery for the best taste and texture.
• Liability: Magic Bite is not responsible for spoilage resulting from improper storage after the product has been delivered.

07 Cancellation & Refund Policy

We have a strict cancellation policy due to the perishable nature of our goods. Please refer to our dedicated Refund Policy page for full details.

• Notice Period: Cancellations are only accepted up to 24 hours before the scheduled delivery time.
• No Returns: Once a cake is delivered and accepted, it cannot be returned.

08 Intellectual Property

The content on the website, including source code, databases (Odoo), functionality, software, website designs, and most importantly—the photographs of our cakes—are owned by or licensed to us.

You agree not to copy, republish, or use our cake designs or photos for commercial purposes without our express written permission.

09 Governing Law

These Terms shall be governed by and defined following the laws of India. Magic Bite and yourself irrevocably consent that the courts of Dharmanagar, Tripura shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
