Comprehensive Legal Agreement

By accessing, browsing, or using the website maintained by Magic Bite ("The Platform"), you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not agree to these terms, you should not use or access this Platform.

The User acknowledges that the products offered (Cakes, Pastries, Desserts) are handcrafted in a home-kitchen environment. Consequently: (a) Visual aesthetics may vary from digital representations; (b) Weights are approximate; (c) The facility processes allergens including but not limited to gluten, dairy, nuts, and eggs.

Visiting the Platform or sending emails/WhatsApp messages constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

We collect minimal personal data required for operational efficiency. This includes: Identity Data (Name), Contact Data (Phone, Email), and Geolocation Data (Delivery Address). We do not engage in the sale of user data to third-party marketing agencies.

The Platform operates on the Odoo Enterprise Framework. Data persistence is managed via secure cloud databases. While we implement industry-standard encryption (SSL) for data transmission, the User acknowledges that no digital transmission is entirely invulnerable.

Magic Bite does not retain, store, or archive sensitive financial instruments such as Credit Card numbers, CVVs, or Banking PINs. All monetary transactions are processed via secure, PCI-DSS compliant third-party payment gateways.

Given the perishable nature of the inventory (Foodstuffs), orders once placed and confirmed are deemed final. The User agrees that the "Right to Withdrawal" does not apply to custom-made perishable goods.

In the event of a prepayment via Online Modes (UPI, Wallets, Net Banking):
(a) The transaction is non-refundable.
(b) Cancellation requests made within 24 hours of delivery will incur a 100% cancellation fee (No Refund).
(c) Refunds are only processed in the event of non-delivery caused solely by Magic Bite's internal failure.

The final payable amount may include: (a) Product Cost; (b) Dynamic Delivery Fees based on geofencing (Distance from Dharmanagar center); (c) Platform Utilization Fees; (d) Payment Gateway Processing Surcharges. The User agrees to pay these charges as presented at checkout.

Magic Bite shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses.

These terms shall be governed by and defined following the laws of India. Magic Bite and yourself irrevocably consent that the courts of Dharmanagar, Tripura shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
